  • Error on LPOA - rejected by bank - who's responsible?

    Hi - I'm new to the forum and wasn't sure whether this would be better in the general board or here.

    I have LPOA for my gran which was all taken care of by her solicitor in 2012. Six years on, someone has spotted that the DOB for my gran is wrong by a day as consequently her bank won't accept it. I understand we have to start all over again with a new LPOA which will take a minimum of six weeks even if they deal with it urgently. Fortunately she still has capacity.

    My question is, is her solicitor responsible for the error even though my gran and I signed the document (and should really have checked!)? Should I expect them to cover the cost of setting up a new LPOA?

    What a pain! Many of the banks wouldn't have even noticed it is unfortunate!
    I would contact the solicitors and complain, flagging the fact you are having to get the whole document prepared again incurring further time and costs of the registration. T
    he solicitor may throw the ball straight back in your court saying the document should have been checked before signing by those signing it
    but they may make an offer to help or assist with the fee. Worth a go definitely. You may need to be a bit stroppy but they may be reasonable.
    It is lucky this has been spotted before your gran lost capacity after which it would became necessary to make a Court of Protection application, the cost of which can be considerable.
    I am a qualified solicitor and am happy to try and assist informally, where needed.
