  • "There be no order for costs"

    I recently took an Executor to Court to get him to provide an interim account of the estate as he refused for 2 years to share any information. He provided the information just before a second hearing so I agreed to a consent order to vacate the hearing. The order included "there be no order for costs". The Executor who had employed Counsel deducted his Counsel's costs from the estate funds. As there was no order for costs was he entitled to do this? Thanks.
