    No formation of contract



    As set out in the Defendant’s witness statement at paragraph 12, the Defendant did not complete the payment page of the Claimant’s online booking process. Instead, noting that the process could be cancelled, the Defendant closed the website and did not pay. It follows that there was no consideration given for the contract, and up until payment was processed there was no intention to create legal relations. This leads to the inevitable conclusion that there was no formation of a contract and the Claimant’s claim must fail.

I worry more reading this thread for the many people who may be scared into paying up to avoid court. I've thanks to this website, just had a call from Radio 4 who tell me their office were raided 2 weeks ago and several people have been arrested. I've been advised to turn up to the court on 25th and defend but to ask the court if I as an individual not a solicitor can, given their arrest and charges, apply for an application to vacate to have it thrown out. However also been told that someone successful secured a claim against them as a counter claim for £1500 for harassment and breach of data protection, which although I'll never see the money, is a matter of principal for the continuous harassment and threats of bailiffs I have received.

            Had you contacted Radio 4 previously ? You & Yours ? Nice they took the time to give you a call

            Can you tell me a bit more about what you have done so far in the court case... as you have a hearing date presumably you have entered a defence and returned your directions questionnaire. When did you first use the passport website ?

            If you can send me the hearing letter on email ( admin@legalbeagles.info ) and if you still have it, the original claim form, I'll sort out access and a thread for you and we will help all we can - you'll also be able to read other people's stories and see how they are handling the court claims.

            Also - what bank are you with ? Good to hear they stopped the transaction.

            No one has lost yet... I think everyone worries they will be the first. There's another 14 cases to be heard (so far) before yours - we've 9 wins so far.... out of 9 hearings.

            No one has been charged following the arrests - the investigation is ongoing so possibly charges in the future, we just don't know.

              Also just noticed about travelling to London .... ? Did you request the case be heard in Newcastle on your directions questionnaire ? Might be worth sending me a copy of the allocation letter too. We might have to ask for it to be re-allocated - have you spoken with the court at all since getting the hearing letter ?
