    A little update.
Receiving Pro-forma invoices from Digital Direct in relation to the advertising that is in place despite them being warned not to go-ahead. At the best, if they did take court action all they would get if successful would amount to very little as they failed to mitigate their losses and anything over and above the expenses incurred by them until they were warned to cease would be undue enrichment.
BUT, Digital Direct? This is a hitherto unknown entity. The contract was supposedly with Patient Direct. Then cam Community Network, Multimedia International Services et al. It seems they have a personality disorder.
Legal action mentioned but not pursued as yet. Roll on.........

This is an unknown entity.... good gracious - any chance you can do a picture of the letter ? Have you checked this Digital Direct out on companies house etc yet ? What's the address on the letter for Digital Direct ? Also pass the new info on to Trading Standards.

I'd keep the letter in your file, although you could write back to them re-iterating your previous commuication that you do not wish to do any business with them and any previous alleged contract has been well and truly cancelled.

Ahhh these ? Direct Digital - www. direct. digital/ about ( broken link on purpose so it doesn't attract traffic )

Dave Ravensoncroft, Angela Darnell and co listed on the 'Team' page and contact address at the Premier House, Poulton address. All their 'international' addresses are maildrop boxes ( suprisingly )

Launched Oct 2017, apparently. Still can't find company details at co house though.

Sent the 1st lot of pro-forma invoices back and denied the existence of any contract between us. Neither they, nor our company are properly named on any contract. Remember.... a non Ltd company is a different entity to a Ltd one, and the signature had been altered anyway.
They called the shop number and asked for my wife by name who naturally didn't bite and wasn't in shop as far as they knew. However they did email me and say that she was known in the shop so would pass the information over for assessment for legal action.

So, next move is up to them. No problem there as far as I'm concerned.

Copy of 1 of the proforma's attached, BUT pro-forma means payment before services carried out to the best of my knowledge. Anyway, suitably redacted for integrity of our business

Thank you for that - it's not very informative is it but does confirm it's the people I thought it was - did they send a covering letter with it or just that?

Actually it's what it doesn't say that is the best bit.
It leads one to believe that a contract exists with Direct Digital when the company name is unknown in any business contract. Also, and this is something that has an impact on the potential for a scam being perpetrated, there's no VAT number shown which is a legal requirement unless it VAT Exempt. It shows an amount of VAT but not the VAT number. You should never have to request a VAT invoice. It's an automatic requirement to issue one.

No covering note sent either. Just a number of Pro-forma invoices.

A little update. We came to an agreement with Patient Direct and they have cancelled my contract and dropped their court claim against me. Glad it's all over and I didn't have to pay them anything so all I lost was my original deposit of under £200

Amethyst kindly placed my last posts into the VIP form for reasons of confidentiality, however there has not been a single answer to my comments yet. I need to have my defence submitted and need help with it.
Amethyst, if you're able, can you drop over and see how best to construct my skeleton defence into something more presentable.
I also need to know how certain things go, such as do I have to submit witness statements with the defence or can they be sent later.
I've also added more things to the already drafted Skeleton. I have found more useful info such as the screens at two of the sites I have managed to visit not being switched on and I also contacted another advertiser who says she has had a similar experience and feels she has been scammed. I need to know if I can use her own situation for a witness statement to show that she didn't get left a copy of the Agreement either or was shown the rear where the T & C's were set out.
I really don't mind the whole series of posts to be kept on this forum either. Patient Direct will shortly get knowledge of my defence anyway.

My concern now though is that of procedure and when the defence must be submitted and to where? I thought it had to be sent to the court that the case has been transferred to but I haven't had word about that.
