    Hello all,

    I was sent a "parking charge notice" by ParkingEye for carpark overstay (ANPR). I've taken it as far as getting a POPLA code and now I'm a bit nervous and unsure how to proceed. Much of the research I've done online is based on the old POPLA system so some advice on how best to navigate the new system would be much appreciated (or, if this has already been provided before, a nudge in the right direction would be perfect!). Anyway, a recap of the story so far:

    On September 6th I parked in Prestatyn Shopping Park for 3 hours and 27 minutes. I genuinely had no idea it was restricted parking and I spent my time there in various shops and the Costa in the shopping park. Apparently there was a limit of 3 hours and I was clocked by ANPR. I live in Scotland, so I'm not able to look back at the signs (and I can't see the car park entrance from street view). I appealed to ParkingEye using hints from various resources I found online (genuine pre-estimate of loss, no-contract etc). This appeal was rejected and I was given a POPLA code.

    So, my main question is how to navigate the new POPLA system? What box do I click for grounds of appeal? Should I name myself as driver? Any other hints and tip?

    When is your deadline ?

    I would try "see appeal" for any questions about the driver etc.

    Until some adjudications are seen it's difficult to advise anything different to the old style appeals. Hopefully they'll still win but who knows. In the absence of any new decisions there is little else you can do.

      Thanks for your swift reply! My deadline is November 9th so have a little time to play with. I'll read through the links you shared and keep you posted. Would you advise holding back on my appeal until nearer the time to see how the outstanding cases play out?

          Hey mystery1! I've had a look through your threads and at the appeals you've helped write for others, they look great! I'd probably end up just trying to copy them...so is there anyway I can be added onto your POPLA to-do list i've seen mentioned? I think it would make me feel a little more confident! My deadline is November 9th. Thanks!

                No change. Popla haven't ruled on penalties (GPEOL) for ages, never on unfair charges as far as i know. Leave them in just in case but it's lack of contract which has been the main winner of late and keeper liabilitywhich has been avoided for much of the time at popla because they only rule on 1 point per winning appeal and i think both are still winners at popla.

                  Whilst Beavis lost in the supreme court i see no real reason to remove the penalty and unfairness arguments until Popla rule on them.

                  That explains entering a popla appeal quite well.

                  You only get one shot so enter everything at once. You may need to convert to pdf, i'm not sure on that.

                    The OP lives in Scotland, I presume the NTK was to an address in Scotland. Surely they cannot hold the keeper liable? The keeper cannot be taken to court in Scotland if they don't know the driver?

                      Ah, I had assumed that because the "offence" took place in Wales it wouldn't be subject to Scottish Law? I've had a fair few tickets up here in my time, all suitably ignored. I have already named myself as registered keeper in my ParkingEye appeal but not as driver. POPLA due in tomorrow, was just about to send in the appeal kindly provided by mystery1. Should the NTK being sent to Scotland change my course of action?

                        Why ? You have a chance to get it off the books. It's not like you are admitting the drivers identity.
