  • Smart Parking@ Asda Stafford - Won

    I need help I have today received the a parking notice from Smart Parking (see attachments) in which they claim that I parked my car at Asda, Stafford on Saturday 29/08/15 from 13.13 to 18.04.

    I know I did not but cannot prove this and I am also unsure if it was me or my wife driving and the photo does not show who was driving

    There are two separate entrance/exits to the car parking site.

    I recall visiting Asda twice that day and have checked my bank account which shows that I made separate purchases on that date.

    I have asked my bank for a statement showing the times I made purchases at Asda and other stores on 29/08/15.

    I wish to appeal but dont know where I stand, need help.

    Dear Sirs,


    I, as registered keeper, wish to invoke your appeals process. The driver did not see any signs and in any event visited the site twice (see attached receipts). I note your notice to keeper is fundamentally flawed when compared to PoFA 2012 schedule 4 para 9.


    Should you reject my appeal please supply a popla code.

    If there are no receipts just delete the bit in brackets.

    If popla is need let me know.



    Also complain to the store manager and if required twitter etc

        Also go into the shop and speak to the manager - Only him/her and insist that they cancel the ticket. Do not take "we cannot do that" Not so Smart parking are employed by them and can be told to cancel.

        This is a typical double dip where their ANPR system failed to register your departure on the first visit.

        Threaten loss of your custom/ friends / family custom - postings of facebook / twitter.

        Stand your ground. Make a fuss for all to hear in the shop. Be polite but firm.

          I, as registered keeper, wish to invoke your appeals process.

          The documentary evidence you have provided does not show who was the driver of the vehicle at the time, if you have this evidence can you please provide. When I have this evidence I can ask the driver if they saw any signage detailing the parking limits and the journeys made by my vehicle.

          I have checked my bank statements and can see that on that date multiple purchases at the Asda store covered by your ANPR system, were made at different times and believe that your ANPR system failed to register the vehicle departure after the first visit.

          I attach receipts which show these payments

          I also note your notice to keeper is fundamentally flawed when compared to PoFA 2012 schedule 4 para 9.

          Should you reject my appeal please supply a POPLA code.

            Although your case is strong on the double visit i see no reason to tell them who was driving as your version does.

                  M1 just quick update, I have today (08/10/15) had an email from smart parking confirming that my appeal was successful and they have rescinded the parking notice.

                  Can I thank you very much for your assistance, I am sure that the advice you gave me was part of the reason the appeal was successful.
