  • HELP PLEASE :( Civil Enforcement LTD - Taking me to Northampton County Court???

    Hi

    Hoping some one can reply ASAP. received a county court claim form on the 10th March. The letter is dated the 4th. I am resuming they are trying to recover ticket costs, however i have never ever received any previous correspondence from these people stating i had committed a parking offence
    i am familiar with this company as i received one a few years ago, just ignored it and it went away. however this one is dated February this year. the letter do-sent state where i was parked? how can i admit this if i dont even know where i am supposed to of parked? there are also 2 other named drivers on my insurance policy so if my car has been parked here, i dont even know if it was me little bit worried as I do not want a CCJ on my record but also do not want to shell out this money for something i cant be sure of? also i am not legally minded at all and do not know terminolgy of this kind of stuff.

    Any help would be good. I have a scanned copy of the letter received if it helps anyone and would massively appreciate some advice x

    You need to wait for the particulars of claim to arrive.


    In the mean time get your own confirmation from SRA that Schwartz has no standing to sign the claim.

    It is my understanding that "Mr Schwartz shall act as a solicitor only in employment, the arrangements for which have been approved by the SRA."


    As he is lodging claim forms with the courts, i would like to enquire if any arrangements are in place to allow him to do so ?

      I'll send this email. Do i need to send any repsonse to the court claim form? What happens if 'the particulars of the claim' arrive after the 14 days i have to respond to the claim form.

      Sorry if my questions are daft i have never ever received anything like this

        No response until the particulars arrive. The 14 days do not start until then.

          Thank you , I am currently reading online forums around this topic but find lots of conflicting information.
          As i have received this claim form, does this mean i have a CCJ on my record? Or when does it turn into a CCJ?

            there's no ccj ... you would only ever get one if you LOST a court case :nod: xx

                And it would only affect the credit record if unpaid after 28 days.

                  Hi guys, me again. Court papers issued on 4th march. No particulars received yet as suggested by M1. I have logged on MCOL and acknowledged the claim, am i right in thinking this give me 14 days to 'present a defence' ? i am really whittling about this whole thing. Do i need a solicitor? Today is 17th march. argggh

                    33 DAYS FROM DATE OF ISSUE xx

                        You shouldn't have done anything until the particulars arrived although it's not a huge deal.

                        Contact CEL and ask where they are.

                          maybe i panicked abit Just phoned number on their website and cannot continue with a call untill i enter the PCN number - considering i never received an original notice i dont have this bloody pcn number. Unless its noted on the court letter, ill have to check later on when im home. thank you
