    hi, I'm new to this but have read through a few of your excellent threads but as each one differs slightly wondered if you could advise please.

    i have received a poorly photocopied letter from civil enforcement ltd and attached to it a two page document on very cheap paper (which made me think it as another ruse) but having looked through the net-i might be about to go to court and of course have left it late.

    the two page document attached is a 'particulars of claim', states background notes, signage, refers to vine v waltham forest and beavis etc and notes my contravention

    the contravention took place in january 2012. The driver parked in the century retail park, dalton way, watford which has three hours free parking and the cameras recorded them leaving just over 12 minutes after the three hours at 17.13 on a sunday. this car park serves a large multi use area for the likes of carpet right, pc world and so on and as such all the shops were then closed.

    they are claiming £241.10 including fees and interest.

    i have similar cases on here and was about to copy and paste advise given by you in response to their claim but figured why not ask directly

    obviously this looks to me like a county court action and as such i need to avoid this

      Post up as many documents as you have but remove names, addresses etc.

      If they don't know who was driving, they are pissing in the wind.

          hi the infamous-M1! thanks for comment
          I'm afraid I've chucked everything as it dragged on over 4 years and each time i got something i kept for 6-9 months then assumed they had gone away so chucked only to receive another some months on, each time threatening more-it escalated to over £400 at one point and then most recently-2/3 months ago i got a last chance offer to settle a very small amount-£90 or so

          regarding the driver-i was the registered (V5) keeper (we don't own the car any more) and at no point did they have any proof as to who was driving nor did i give them any evidence.

                      File acknowledgement of service as that gives 14 extra days to enter a defence.

                      It is my understanding that "Mr Schwartz shall act as a solicitor only in employment, the arrangements for which have been approved by the SRA."

                      As he is lodging claim forms with the courts, i would like to enquire if any arrangements are in place to allow him to do so ?

                      I advise that you get your own confirmation in case it comes in handy during this matter rather than rely on everyone elses reply which confirms it.

                      This has no effect on the court time scales and we must keep to those.

                        thnks M1, will file acknowledgement and email letter; should i take it from that i should expect to go through to court but perhaps hope the latter above may give me fuel against their standing?

                        you also commented above on proof of driver-is this also fuel for my case?

                          The court may take action due to the solicitor issues but then again might not.

                          Pre October 2012 the keeper could not be held liable and it's rather difficult for an ANPR camera to id the driver. Without an evidence of the driver they have no case.

                            i sent the note to SRA and got this;

                            Dear Sir/Madam,

                            but wondered what i can do about your point above? regarding identifying the driver prior to october 2012-which counts for my case
                            can i write to someone?
