  • CCJ repealed - Court hearing for initial penalty

    Hi everyone!

    First time posting so hopefully I am in the right section.

    In April 2015 a PCN was issued from a local carpark. A ticket (Excel parking) was bought and displayed however the car was not parked entirely within the bay. However this occurred at 18:30 when the car park was near to empty. I currently reside abroad and was at home for a holiday when the incident occurred. I did not receive any of the correspondence from BW Legal as I was not living in the country. Eventually I heard of the PCN when an old neighbour forwarded on the notices to my mother with one being that a CCJ had been made against me as I did not show up in court (out of the country with no knowledge of the PCN). I went about getting the CCJ repealed which I won successfully. However I now have a court date for next week for the original parking fine (£236). I've received Excel parkings defence from BW legal which shows pictures of my car parked over the line. In the background you can see how empty the carpark is. In the defence pack they also include pictures of an extremely busy carpark taken nearly a year before the incident occurred, with no sign of my car. I've received numerous letters from BW legal offering the amount to be reduced or letters advising me to withdraw as they feel I am unlikely to win the case.

    I'm a bit unsure as to what my defence should be. The court case is next week and I'm starting to panic slightly as to how I should go about the whole thing. Any advice would be greatly appreciated.
