  • UKPC Parking Charge - Can I get reduced Charges?

    Hello,

I parked in the car park located under my friends apartment in London. I parked in her space and she drove us to the airport. She is entitled to 1 visitor permit however her landlord had not yet sorted it. There was a sign clearly displayed stating the penalty should someone park there without a valid permit however I thought this would be ok as I was allowed by the tennant to park in her space.

The car park is always half empty and as I was parked in her space I was not obstructing anyone who had a permit to park there.

I was issued with 4 tickets over the time I was away totalling £400 (£240 if paid within 14 days). I feel this is extortionate and completely unfair considering the circumstances.

Do I have any grounds to appeal to just pay for 1 charge rather than 4?

Your help will be much appreciated.
    Thanks

POst up a copy of one, a copy of the signs and get your friend to 1. check their lease and let me know what it says re parking. 2. confirm in writing (email is fine) that you had their permission to park. (assuming they have occupier rights UKPC can bugger off)

Personal info isn't required and should be deleted from any letters.

Excellent. Thanks Still waiting to hear from my friend about occupiers rights! Is there anyway my friend (who also got fined) can appeal with regards to them not replacing the visitor permit? I feel it's probably a long shot but thought I might as well ask.....
              Thanks

                Wouldn't worry about that.

Keep your powder dry until you get a notice to keeper (you'll get 1 per ticket). This gives them more opportunity to screw it up so that we can win. They should arrive after 28 days but before 56 days.

In the meantime keep the identity of the driver a secret.

                  Hi M1,

Their tenancy contract doesn't say anything about occupier rights with regards to the parking.

I have read that UKPC would have to establish if there was a contract, whether I intended to form a legal relationship, was there a breach and if there was a loss. Also that it's not binding in law because its a private company. So to ignore the tickets. Is this true or is it old advice?

                  Thanks

It must say something about parking if they have a dedicated space ? what gives them the right to use the space ?

OK well since your friend has nothing on parking in their lease stick to the above.

Still be interested to know how she was allocated a space plus visitor permit which apparently she isn't entitled to.
