I have received 2 of these letters now and the vehicle has parked here a fair few more times since, im expecting this wont be the last we hear from them.

As you can see from the dates on the letter, It has taken over a month just to be sent out and pushing 6 weeks before it even come through my door.
Had i received one straight away further parking notices could have been avoided, but now we're expecting at least another 4 from this date and just wondered where we stood and if we legally have to pay as it was a private firm who sent me the letters.

we havent made any contact with the company yet and have not admitted to being the driver etc...... any help would be much appreicated.

    thanks
    shane

    UPDATE

Ive just looked at the photos online and no actual pictures the driver, just the van parked itself if this makes any difference ?

Under the POFA section 9 (4)(b) & 9(5) the notice has been sent after 14 days after the date of contravention.

    ^^^

Does this mean they've sent the letters out too late ?

Ostell posts help on all the forum members' parking threads (over 3,000 times) regardless of any friendship connections.

I recommended that my friend post this and told him I would tag in Ostell to help him, if I needed your input I’d have tagged you.

I suggest you stop posting on a parking thread then or is that you just post on every thread you see my user name attached to?

            bye then!

You are correct, more than 14 days then no keeper liability, assuming no windscreen ticket. There are also othe paragraph 9 items missing. Search for a suitable BOGOFF response either here or on PePiPoo

I don't normally respond to tags but as Diana says I pick up on most parking threads. No need to gave Di hassle about it, she also helps on parking and is more qualified and experienced than most of us.

Sirs, I am the keeper of vehicle xxxxxx and have received your Parking Charge Notice xxxxx,

I note that the statements required by paragraph 9 of the Schedule 4 of The Protection of Freedoms Act 2012 are not present in this letter and I, as the keeper, can therefore not be held liable for the actions of the driver at the time. I have, as requested, passed on this notice to the driver but as there is no legal requirement to identify the driver I will not be doing so. I will rely on the driver to contact you separately.

I do not expect to hear from you again on this matter other than to confirm that no further action will be taken against me..

I see this posted elsewhere, is it okay for me to just copy what has been wrote ? or is it regarding something different ???

I cannot be held liable for the actions of the driver as you have not complied with the requirements of Schedule 4 of The Protection of Freedoms Act 2012, namely, but not limited to, failing to deliver the Notice to Keeper within the relevant period of 14 days as detailed in section 9 (4) of the Act. I have, as requested, passed on this notice to the driver but as there is no legal requirement to identify the driver I will not be doing so. I will rely on the driver to contact you separately.

That original was written for slightly different circumstances.

                        Hi Ostell,

Ive sent these letters off but keep recieving letters saying that my fines havent been paid.
Normally id ignore them again but as the motor is registered in the father in laws name his panicking.

What do you think my next step should be? He's putting pressure on me to just pay them off.

                        Thanks
                        Shane

Letter from debt collectors can be ignored, just file them away. These are NOT fines.

Would it be wrong to tell them who the driver was so they received the letters not the owner?

They have a claim against the driver, they do not have a claim against the keeper. If they know the driver they will proceed smartly to court.

It is never advised to identity the driver, edit that post so the driver can't be inferred.
