MET Parking Fine

  • MET Parking Fine

    I have received 5, yes 5 of these fines! Are they legitimate and should I pay them? Someone told me that I should ignore them because they are unenforceable but I don't really want to end up forking out £100.00 for each when at the moment they are £60.00 each.
    All advice greatfully received.

    Hi & welcome to LB.

    Some background info would be helpful.

    Do you live in England/Wales?
    Is the vehicle on HP/lease? Company vehicle? Etc.
    Private land?
    Were there windscreen PCNs?
    Where did this happen? Same location for all?
    Residential?
    Do you have the PCNs/Notices to Keeper?
    Do you have pictures of site signage.
    Have you made any appeals?
    & any other info which may help.

    Do not ID who was driving at the time(s).

      Hi there, thank you so much for your response.

      I am in England. The car isn't leased etc it is owned. I received the notices through the post but did not have anything left on my windscreen. I have not made any appeals but I can get photos of the signage which has been half ripped down so you can't really read it properly. And yes, they are all in the same location. I have the PCN that they sent through the post. They had pictures of the car on them but for all I know that could all be on the same day and they've just issued 5 fines in the hope that I will cough up! I'm so annoyed with myself and them!! I didn't realise that it was a "private" car park if I am honest! Other people seem to park in there and there is nothing stating time limits etc either.

        Ok

        Could you post up the fronts of all the postal Notices to Keeper, & if they are all the same on the rear, one of those? (Rear).
        Obscure personal details but leave all dates visible.

        Also post up pictures of site signs.

          Hi there,

          Here are two of them. They are all the same on the back and the other three just have different dates but the same information on the front except different photos of the car. I don't currently have photos of the signage but I can get that tomorrow and post it if that helps at all.

                        Imho the 2 NtKs are not compliant with PoFA (Protection of Freedoms Act 2012 Schedule 4).
                        If so there can't be a transfer of liability from driver to registered keeper. (You have received Notices to (registered) Keeper.
                        The onus is on them to ID the driver.
                        So don't tell them who it was.

                            Do I just ignore them then do you think or do I need to appeal on the basis that you have described, that they need to prove the liability?

                              Since your Notices to Keeper fail to comply with the Protection of Freedom Act 2012 Schedule 4, as such there is no keeper’s liability.

                              As there is no legal obligation to name the driver; I am within my legal right not to do so.
                              In law you may not assume that I, the keeper, was the driver on these days.

                              No further information will be provided at this time; cancellation is your only viable and reasonable option.

                              I would request that you remove my personal data from your records, & advise you that any continued use of same by yourselves is a breach of the Data Protection Act 1998.

                              Should you decide to try to continue with your baseless actions, I request that you send me all the necessary information required to appeal via an independent body, which will be fully utilised.
