    Hi M1,

    Funnily enough I just got a phonecall from Bw Legals Solicitor's...I can only imagine it was to try and trip me up with questioning before the mediation. I told him i didnt wish to discuss any thing as we had the mediation booked in for today. Did I do the right thing or should I have heard him out? I wish I had asked him why they still havnt sent me a copy of this supposed fine!! Grrr they make me so angry!!!

        M1 Urgent Update

        They have comeback and said i appealed the ticket back in 2012 when it occurred. I checked my emails and this is correct I wrote to them saying I was very angry as I used this carpark frequently and always paid. I told them I had proof of a paid ticket and would be seeing them in court if it came down to it...now its 5 years later!!! Where would I find my ticket now after all these years!!!

          They said after I said that they went through all tickets purchased on that day and that I had stayed 260 minute's implying that I had indeed paid for a ticket but gone over the paid time! I have no idea if thats even true or not? They offered me £175 to close case at first and this 2nd time have offered me £150 instead to settle this...what should I do...the mediator has offered to give me 30 mins to make my decision

                So they know who was driving now, which is a pity.

                I would write to BW Legal and request the information they used at mediation, like the fact you were over the time paid for (what had you paid for etc).

                There is still an argument about the "fine" being buried in the small print etc

                Have a good look for the ticket, it would be handy to know if you paid for enough and the machine rejected/missed a coin or you were simply late.

                  yep found it so thats good news.

                  Have asked them for the information at mediation now also..So will wait for this....hopefully not for another few months.

                          ok thankyou. Can you help me with a rough estimate of costs if I do follow legal route and lose? I know it will be a rough estimate but need to weigh up pros and cons.

                            It'd be unusual to have more to pay than the already vastly inflated claim as long as you follow court instruction put forward sensible defence points and are generally reasonable.


                            I would reckon on paying less than £250, if you lose to be honest.
