  • Legality of a company advising of parking charge notice

    I would appreciate advice on the following. I received a parking charge notice today 20 August 2015) dated 14 August 2015 but advising of a parking charge for 15 June 2015. Have called the parking company asking a) why has a notice taken so long to reach me and b) why does it state £90 full balance or £90 reduced to £90 if paid within 14 days. Responses were a) we are in process of moving systems and admin have only just sent out notifications b) error with admin letter and should read £50 as reduced charge. This seems very odd to me, what do others feel? Appreciate your comments with thanks.

    Was therre a ticket on the windscreen? If not then they have failed to make you liable for the ticket. Don't tell them the name of the driver

        It's one of those photographic sites, letter states I am bound by contract as I entered site and they received my details from DVLA. When I called yesterday and asked a number of questions, 1 being why no ticket on my windscreen? I was advised that they have pgotographic evidence of me leaving the site.

          Have you told them who was driving, expressly or implicitly ?

          Can you scan up the PCN suitably sanitised.

            Couple of comments.
            When they say they have photographic evidence of "you" leaving the site is that you or your car?
            I presume that this is railway land subject to byelaws and therefore NOT relevant land to hold the keeper liable under POFA If they don't know the driver then they are going to have difficulties.
            Was there signs giving details of the T&C's as you entered the car park?

              Correct but i suspect as they've appealed a notice to driver that they will have implied or even directly named the driver. Still, we've never lost at popla so far even in those circumstances so unless the new mob change tack or Beavis changes the landscape significantly against us, we should win.
