  • PCN Smart parking Ibis 14mins

    I'm in need of advice as whether to fight this ticket or simply pay.
    The driver was lost in Coventry after misreading satnav during one of the hottest days of the year, the cars model is renowned for the Aircon not working especially on a ten year old model. The driver's baby was really hot and suffering in the back so they pulled off the roof and into the first safe place they could see to pull in. This turned out to be an Ibis hotel. They opened the windows and doors and fed the baby. The car park was empty save for one car.
    They were there for 14mins total and then left. They didn't see any signs but had other things in the mind to worry about. I've attached photos. Any help recommended.

      Quick glance and it's not POFA compliant and therefore they cannot transfer liability to the driver. I'll add to it in an hour or so when I get back from sorting out somebody else's computer.

          This should do:

          Sirs

          Ref PCN xxxxx VRM yyyyyy

          I am the registered keeper of the above vehicle and am in receipt of the PCN you issued. I have no liability on this matter as you have failed to meet the requirements of Schedule 4 of The Protection of Freedoms Act 2012 namely, but not limited to, failing to give the warning to the keeper, contrary to section 9 (2) (f) of the Act. You cannot therefore transfer liability from the driver at the time to me.

          There is no legal requirement to identify the driver at the time and I will not be doing so.

          Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

          Yours etc.



          This will not get rid of it but they will give you a POPLA code and listing all the POPLA fails should get it cancelled.
