Help to VT WITH MARSH FINANCE

Please help someone we are struggling to make payments and asked marsh finance for options. They basically only came back with VT. we have only paid the the car for a year and have not missed any payments but my husband is now on half the wages he had when we took the car. We were trying to improve his credit rating but they have not registered the payment with an agency. Is this breach of contract? As it says in contract that they will? We want to VT Aand know we will be liable for half the amount but they're said the car auctions sake will
Not go towards this. Isn't this highly unusual ? Can we do anything about this? At the moment we are going to owe £7100 and we will be carless. I need a car for my job. Help!!

You seem to be in a bit of a sticky situation I think. Ultimately I dont think that a failure to update the credit file will affect the legitimacy of the contract and is minor issue not a fundamental one to allow you to terminate.

IF you need the car then the only other suggestion I can think of is to make a formal complaint and then go through the Ombudsman if you are not happy. They should take into account the circumstances and financial situation and its not as if you are refusing to pay anything, but you would need to offer something reasonable that can fit in with your finances. £5 per month just isn't going to cut it.

Under the FCA Handbook CONC 7.3.3 sets out that firms must treat customers fairly and with forebearance if they run into financial difficulties. That is to say that they should refrain from exercising their legal rights and 7.3.5 sets out examples of what they could do.

You should raise that in your complaint and see what they say to that, otherwise heading to the Financial Ombudsman would be the next steps.
