  • Court summons for no tax

My son bought a car on 31.10.17. The garage agreed to tax the vehicle for 6 months. My son received a letter saying he was caught on pncr on 1.11.17 0745am and checks showed he had no tax. However, vehicle was taxed from 1.11.17. Wrote back to show DVLA records showed car taxed on the date he was caught on camera, and tax reminder sent out showing vehicle tax due to be run out on 30.4.18 (6 months from 1.11.17!). Now court summons received for the same charge
so, why are they still pursuing this?!
Any ideas? I'm furious! Summons indicated costs applied for from 31.10.17, the day car was registered in his own name, even though the date of the alleged offense was 1.11.17!!! Surely they can't find him guilty of an offense the day before the alleged offense was comitted?
can anyone tell me what I am missing here? Should I be worried about the court hearing?
    thanks in advance

He would need to provide proof that the tax was obtained prior to the time he was alleged to have been caught & not after, + the car should have been taxed on the day he bought it..

Probably the garage didn't tax it until later in the day on the 1st, so when he drove it home on the 31st it was also illegal.

Don't know how you stand on this, suggest not very good, although to be fair if a garage told me they were taxing it and let me drive it home, I'd not have done anything else.

Your best defence is anything you have from when you bought it to say it was taxed there and then on the 31st.
