  • PCN - Alleged parking in restricted area outside School

    Hi All,

    Please see attached files. I got a ticket issued 30.04.2018 for allegedly parking on the zig zag outside a school, date of contravention is 20.04.2018. Fact is that I made sure my tyres did not touch the yellow markings. But the Council with some very grainy photo evidence have issued a PCN. I can see my front bumper over the yellow line but my wheels definitely did not cross or touch the yellow line.

    Any help is greatly appreciated. Thanks in advance

    So your car was over the zigzags. I don't think that one would win at appeal.

      Looking at the streetview from 2016 there are 4 zags so your car is over two of them... there is a gap in the zigzags behind that for a car/van length and then the zig zags continue. However in the streetview they already look quite faded so might be worth taking pics of what the actual road markings are like now from a similar angle as the picture.... but also there are signs up along the side of the road with parking restrictions so check those too, but otherwise I'd agree with Ostell.

        If any part of the vehicle overhangs there is an offence if the signs are correct and comply with the regulations.

          Hi everyone,

          Thanks for replying. The ticket was given when parked on School markings which come into force from 2.30pm. I actually came to the car at that same time to move it and thought I still had a minute or so to do it. The CCTV car saw me yet still proceeded to ticket me and the photo stills show my car there at 2.30.08 sec to 2.30.11 sec. Thus giving me hardly any time to move it. My watch was a minute or so off.

          Is there any reasonableness to be applied when issuing tickets as its such sharp practice to simply go ahead and ticket bang on time. Do I have any chance of winning at an appeal?

          Please see attached signage and I appreciate all replies.

            Reasonableness is not a virtue often displayed by civil enforcement officers!

            I wonder if you could argue that you were not parked, but were driving off but had to await for other traffic (even the CCTV vehicle) to pass before pulling out.
            It would be necessary to view the cctv film to see if you were in the driver's seat.

              The video is crucial as to timings and sequence of events. You'd be surprised how many times the video differs from peoples recollection of events.

              The full penalty is now in play and so you have nothing to lose by going to ajudication

                The stills show me at my car at exactly 2.30.11sec. The full penalty comes into play after 21 days, I'm at the 20th day so still time to pay. Unsure now!

                  Well, you haven't exactly been proactive, leaving it 16 days before coming back during which time you could have viewed the video and therefore have the full picture on which to make a decision either way.

                  Maybe paying the discount would be for the best
