  • Missing liability order

    I have two liability orders for council tax and they were passed to Rossendales. I think I may have paid one up now but it is very difficult to understand their payment records recently received. As such I wrote to the council asking for a copy of the original orders plus details of charges and payments made. Some six weeks later they tell me they no longer have access to the first liability order and also do not have a record of payments. Am I still liable for this one even if I made payments on this ?
    Also they sent a copy of the councils 'enforcement of council tax;notification of liability order and notice requiring information of earnings or benefit' for the second order-I asked for the actual court order but I am not sure if this is the same thing??? or should they have something from the court.
    If I am not liable for the first one now can you please advise me of what to do next please?

    You need some questions answering from both Council & Bailiffs. You need to speak to someone at the Council and ask the following questions:
    1 - how many Liability Orders they have against you
    2 - the dates they were obtained
    3 - the addresses they were for
    4 - the period of time each covers
    5 - how much each one was for
    6 - how much is still outstanding
    7 - the dates they were passed on for enforcement
    8 - the dates & amounts of any payments

    Next send off to the Bailiffs for a breakdown of their fees. Use Letter 1 from & send initially by email followed by a copy in the post.
