    That was my whole point. At the moment the EO may decide to be as obstructive as possible especially if they feel threatened. I am a firm believer in following due process. Remember at the moment she has the power in the relationship. I would be picking my battles and waiting for the tenants to be gone.

      I know you are probably right, but being backed into a corner with frustration and desperation I feel I have to get some control back .
      I believe in giving people respect and yet this woman has given me none.. watch my latest action bite me up the rear !!

        I do hope it doesn't. I am truly a person who likes the last word - which with my friends is a problem- sometimes I just sit back and think... Karma.

            Diana I have just heard back from EO . The problem with the sockets is that the system is at full load and to add anymore would not be a small job or cheap.
            The EO emailed this morning and I obviously rattled her cage somewhat... she states that as it was a schedule of works rather than an enforcement notice then there is nothing to withdraw, however, she states that if the property is re-let in the future then she has no choice to enforce the works and she will be watching the property closely after eviction.
            It does seem that the property has had interest from first time buyers only but I am concerned she is unfairly targeting me . Below is a copy of the EO's reply:

            Thank you for the update. Your comments are noted and I will clarify that a formal notice has not been served as yet. A schedule of works was sent to you to give you the opportunity to carry out the works by agreement.

            We have considered that you have intentions to sell the property once the tenants move out; therefore we are currently monitoring this but we will review it in due course, particularly if the property is re-let and the works are not completed. In this case, we may consider serving a notice under the Housing Act 2004 with the corresponding charge. We are not bound to withdraw any notices unless all the works stated in the notice are completed.

            I am at loss with how to shake off this person as even if the arrears weren't what they were there is no way I would re-let this property again she would be forever on my case .
            All the works were carried out immediately or as soon as I could gain access so not sure why she is so obstructive

              I am not defending the EO but I do feel you are taking this too personally which I admit it is to you, but I don't think she is being as heavy handed as you think she is, I feel she was when you had tenants, (I know technically you still do) but now they are leaving she is just covering her own a$$e, as you say she's new, she hasn't mellowed, chose your battles wisely, this is a non event, ignore her, you're selling, not reletting, hope it all goes well for you.
              Sorry i'm just thinking out loud, it might be irrelevant, I am not employed in anyway in the legal profession, please ensure you research any advice I give before using it I have been known to be wrong on multiple occasions.

                Phaeton.. yes I see your point, I'm just wondering in the future and if it was re-let whether this would come back to me.... she is horrid though !!

                  It seems that since post # 91 you have been under the impression that you had been issued with an Improvement Notice when it now appears you weren't.

                  This is good news isn't it?

                  Perhaps you need to work with the EO and not against her in order to tidy this up before you find a buyer since you'll still need to disclose it during the conveyancing process.

                  It would help you if you are able tell the solicitors for any buyer that the 'case is closed' backed up with an email/letter from the EO to confirm.

                      Thanks Di, as soon as an offer is accepted I need to send an email to her to state this just to cover my back in future... The thing is this was so unnecessary as as soon as I knew there was a problem which initially was a leak in the bathroom and subsequent discovery that tenant had re-arranged the kitchen without permission then I immediately set about getting it replaced and this was before the EO had been bought in.

                      It sounds as though I let the place go to rack and ruin which I didn't and apart from the bathroom which had water damage the place looked in good order.. the notice I was served was for the above and cooker below a ring main.. rad valves, insufficient sockets for tenants use in bedroom , missing skirting, smoke detector had no batteries and similar bits and bobs.
                      I just felt she could have approached me in a less threatening manner

                        I think this may well be my last update on what was a very long thread but replicated by the very long process to get to this point.

                        Eviction went ahead this morning, my husband went and was told to stay away by the bailiff.

                        It was very clear the partner had control of the situation and was always threatening after the bailiff had left and OH was securing the property

                        No more damage to the property than what we already knew apart from monumental rubbish ..they had allowed a friend to store their rubbish in the garden as they were being evicted so all viewings will be suspended now until after xmas
                        It didn't feel a victory due to a very small child being involved but thankfully they aren't old enough to understand their first xmas

                        I would like to thank each and everyone of you who contributed especially Diane M ,Wyldrose but especially Crazy Council who virtually held my hand throughout the long arduous and harrowing process.

                        I have realised that you must detach your emotions and press forward, the legal system works for some but not the bona fide LL who does everything to ensure you do the right thing .

                        There is a twist to this sorry mess but for now thank you for being there, in the early hours , weekends and every other time I have needed a hand

                        I am sure I will need help again in the future but I'm hoping this thread from start to finish may help someone with the whole process and hope in the future it may help someone else in a similar situation.

                        If I can help anyone at some point then at least this has had some advantages .

                        Have a safe Xmas and a stress free 2018 and like Arnie said "I'll be back"

                          • Good Morning Beaglers hope all is well.. Thought I'd give an update to you all

                            Completion for the sale of the flat went ahead last Friday. I paid 525.00 to have the rubbish that was left behind moved ... and approx 3k for all other repairs.

                            2 trips to the police station to hand in drug paraphernalia ...

                            I hope if anyone has similar problems I will now hopefully be able to help .

                            I will never rent any properties out now apart from one other long term rental I have but the couple in that one have vastly improved it rather than wrecking it so happy to have them

                            I had a history of industrial rental which is so much easier... with what has gone on with this one I worked out it has cost me 25k in unpaid rent, repairs, refurbishment which was necessary plus legal costs .
