  • Removing/Adding somebody to tenancy (Complicated)

    This is quite a complicated situation that I would like to hear some input on.

    I am an adult, and I live with my Mum. She has rented the home with live in since 1995, when she began renting it as a joint tenancy along side my father.

    My father left the home in 2007 and has not paid any rent since, in fact we haven't even seen or heard from him since.

    He has remained on the tenancy because we are unable to contact him because we don't know were he is, plus even if we did, contacting him is not desirable thing for us.

    We recently contacted the housing agency about this issue again, as I would like to become a joint tenant along with my Mum. But they again said that there is nothing they can do, unless my father contacts me, unless my Mum cancels the existing tenancy and we open a new one together.

    The new tenancy is a bit worrying, mainly because we are not sure if the new tenancy would be long term assured.

    If there is any advice about this, that would be great.

        Can i ask is your landlord Private, housing association or council ?


        Going on what you posted so far, Do Not agree cancel and start a new tenancy as you would almost certainly loose your existing Assured Tenancy "Secure tenancy"

        And end up with a AST which is easer to evict the tenant.

          Hello,

          The house itself is owned by the council, but we pay our rent to a housing association (Moat Housing) and they take care of all of the maintenance and that side of things.

            OK Thanks

            IMHO

            Just leave the tenancy as it is "joint" not worth the hassle changing it.

            Assured tenancy give you more security anyway.
