  • Case law - seizure and retention of property (PACE)

    Hi

I would be most grateful if anybody could point me in the right direction concerning any relevant case law regarding seizure and retention of property (Police and Criminal Evidence Act 1984) where the court ruled the police/public body to be trespassing to goods.

    Thank you

    Try these for starters:

    Ghani v Jones,1970] 1 QB 693

Gough v West Midlands Police [2004] EWCA Civ 206, the Court of Appeal

    (1) BRIAN CASH (2) WILLIAM BROWN v CHIEF CONSTABLE OF LANCASHIRE . [2008] EWHC 396 (Ch).
