  • Doctor wrote offensive remarks

I got access to my notes via a SAR. I found that a locum surgeon who did surgery on me that ended up being a nightmare, wrote offensive statements in my notes that were totally irrelevant to my clinical history.
He worked as a urologist at the hosp in 2016 and apparently was sacked. He isn't from the UK and I found his whole manner awful, very rude and obnoxious I haf the surgery and ended up with severe complications due to things he shouldn't have done. He also didn't obtain consent for various procedures he carried out.

I had an appt back at the clinic after the surgery and it was him doing the clinic. I was shaking and felt physically sick. I have been under urology for.over 9 years, im only 30 with chronic illness. Anyway, that day I made it clear i was not happy with what he did and tyat id be complaining, that I ended up looking disfugured for months thanks to him.
He wrote in.my notes a clinical statement and then finished it with i feel that I should add she was rude, obobnoxious and had a condescending tone to the nursing staff and urology team. I was flabbergasted. The only nurse there was the specialist nurse I've had for years who I have a great relationship with. I am honestly so shocked.
I have ended.up in hosp after that, I had no idea it was in my notes, and I did feel two of the urologists were a bit off with me. Now I'm starting to realise why they maybe were as that statement in my notes does not look good.

Did he have the right to write that in there? It wasn't clinically relevant.
As he no longer works for the board what can I actually do other than complain? I already submitted a complaint about him and the surgery before that ended up at yhe ombudsman and they weren't satisfied with him.

Apologies for my spelling errors and fullstops everywhere, using a very slow phone.

In my experience they can enter what they like in one's medical records and only have to argue it 'may be relevant' and this is compliant with the Data Protection Act 1998. Of course, almost anything could be relevant.

It seems to me your only recourse is to complain that the note is inaccurate (which I suspect the Trust will deny) and, failing that, ask that a note be added to your medical records setting out that you disagree with the statement in question, whilst giving your reasons.

You could also complain to the General Medical Council because their guidance clearly states medical professionals must keep accurate records.
