  • Divorce husband not disclosing all assets - what can be done

I'm asking this question on behalf of a friend and any feedback or pointers would be much appreciated. My friend has been told her husband is renting rooms on a cash-in-hand basis. He has admitted to having one tenant but she gathers he has at least one more if not two or three more as he lives in a big house. But what can she do if he is not disclosing that information? It's his word against hers, presumably.

        Hi vitamin33,
it is a tough one, digging too deeply could cause a lot of issues when you’re trying to reach agreement on the division of assets I assume?
Do you have any evidence he is letting more than one room, would anyone be willing to provide a statement confirming this?
Of course any income needs to be declared, which from what you indicate, may well not be the case.
Do you have a solicitor or are you tryouts no to do this yourselves?
Maybe HMRC would be I teresed but now may not be the right time if you are trying to settle matters between you.
feel free to give some further information but as far as the rental income is concerned without evidence it would be very difficult to prove without going to some expense yourself, I would suspect.
I am a qualified solicitor and am happy to try and assist informally, where needed.

Any posts I make on LegalBeagles are for information and discussion purposes only and shouldn't be seen as legal advice. Any practical advice I give is without liability. I do not represent people on the forum.

If in doubt you should always seek professional face to face legal advice.

Sure Peridot knows far more than me but is there anyway of seeing who he declares regarding council tax as i am sure they would have in interest in it if he is saying he lives alone and they would probably investigate it.

Thank you very much, Peridot. My friend has been told by separate sources that he has tenants, but they don't want to get involved, e.g. wouldn't put their name to anything to say as much. I doubt he's declaring to tax man, but who knows. Thanks for your thoughts, much appreciated.

Thanks Brig76, that has crossed my mind, whether he's claiming the single person discount, but my friend can't get access to whose on electoral roll, the online version is outdated, and he has only been doing this since last spring, which is when they split up, so only the current electoral roll would be useful.
