Name Changed by Mother of Child

    Hi,

I won't go into the gory detail but suffice to say, I no longer see my 9 Year Old son (both his and my choice) and the mother wants to change his surname to hers via Deed Poll. the child has her surname as a middle name and mine as the last, and she just wants to swap this around.

I sent a quick letter to her accepting this decision to allow her to do that as I have parental responsibility (we do not communicate whatsoever (my choice)).

I thought that was all and this would then happen, however after a couple of months I receive a drafted letter in legal terms stating the name change etc and I have to sign it to agree (it has witnesses on it etc), although it is not on headed paper so no proof of what legal firm has actioned this (I suspect he Mother as she is a retired conveyancer).

I personally don't think I should have to sign this, as my letter sent previously gave my consent, and once changed by Deed Poll I thought that was it!

Some advice would be great, as I dont really want to sign this as it is not necessary in my eyes, plus some of the wording is ridiculous as well as giving me a middle name, which I have never had!!

    Thanks in advance

The letter was meant to look official but wasnt really.

After all this time I just signed it to get rid to be honest!

Has she said why this new one needs filling in?? Is she using an internet company for the DP or a solicitors firm??

if it's wrong don't sign it IMO ... although a letter of consent (from YOU) will be needed for her to change the child's name via deed poll as you have PR.

You could draft your own letter along the lines of:
    [Your home address]
    [Your daytime telephone number]

    [Date]

    To whom it may concern.

    Dear Sirs,

I, the undersigned, having joint parental responsibility for [insert child's current full name here] consent to [his/her] name being changed to [insert new full name here].

    Yours faithfully,
    [Mother/Father's signature]

    [Mother/Father's full name]

    [Mother/Father]
