  • Internal interview, position already filled

    Hi all,

Thanks in advance for any help.

I have been with my current company for five years. I recently applied for a technician's job and was given an internal interview.

The interview itself was very informal and over very quickly. I found out shortly afterwards that the position had been given to an external applicant three days prior to my interview. Although not 100% certain, I am fairly sure that the job had already gone before it was even advertised internally.

I am fully qualified to do the job, and have an excellent employment record. I would completely accept losing out to a better applicant, but would have preferred that I was told that I wouldn't be interviewed and that the position was already filled rather than the company to 'go through the motions' of an interview when there was clearly no possibility that I could get the job.

I am just curious as to whether what they did was legal under employment law?

    thanks again for any advice.

I think Militant or Teaboy2 are best to answer this one to be honest but you would probably need to be 100% certain that they had already given the job to someone else.

        Thanks for the reply.

The initial memo advertising the position was sent on 20th September.

The closing date for applications was 28th September, My interview was held on the afternoon of the 28th September.

I have seen a letter sent to the external applicant confirming that he had been accepted for the position, dated 24th September.

        Thanks.

Forgot to add, I submitted my application on 25th September.

I don't know if that makes any difference?

          Thanks

To begin with i would be putting in a polite letter to personnel asking for an explanation, if you are still not happy then a formal grievance, especially if it results in a major pay grade change
