  • stressed and my brain hurts!!!

hi all hope your well. just looking for a bit of advice if anyone can help.
my bf workes for a small cafe (been there for 3 yrs) when he started he was being paid for 37hr the business is in trouble and he's now being paid 33hrs sometimes 32.5 but hes still working the same shift? he raised the issue only to be told he gets paid till the shutters go down regardless of how long it takes to clean up more so caus other staff stand round and talk, he also got told that working hours are rounded down to the nearest quarter so in all he looses out 30 mins somtimes more (not a lot i know, but it all adds up) each week.
his boss can be unaproachable as i found out i poped in to confirm dates he needed early fin and late start to addend a wedding only to be shouted at about other staff members holidays and her staffing issues. now im rambleing sorry!! but its just sooooo frustrating.
bottom line can she round his hours down so he looses pay?

Yes to simplify wage payments, every ones pay is rounded down quarterly.

Re: stressed and my brain hurts!!!

Sorry but can you explain how when he works the same shift his pay went down from 37hrs to 33hrs then to 32.5 hours? What are his contracted hours stated in his employment contract? As i can not see how it is possible to go from 37hrs pay to 32.5 hours as that is nearly 1 full days shift.

His hours should only be quarter down if hes late for work. If he stays back after work more than 15mins after his shift then hes entitled to an extra 30mins pay unless his wage is salaried and not hourly, but from what you put it appears hes hourly otherwise they would not beable to deduct 15 mins pay for being late for the start of his shift. You need to be a bit clearer and percise as i feel you haven't explained the situation well and it does sound like your BF's employer is undercutting your BF on his wages which is a breach of contract and a breach of employment rights act 1996.

If the business is in trouble and they need to reduce the wage budget, then the employer quite frankly appears to not know how to handle it, his first step would be to reschedule the staff rotata to be more economical, which would reduce peoples hours but would be fair to all and avoid redundancies. Next step would be redundancies which would put more workload on the remaining staff, but would help the business to survive and restructure so it becomes economically viable again. Sounds like the employer is putting his head in the sand and as a result will not likely be in business much longer if hes in serious finanical trouble.
