    Hi Everyone,

    I'm seeking some advice for my partner who I feel has been treated very shabbily at work. However her situation is such that the legal position is not clear to me.

    She was employed by an agency on a Temp to Permanent basis, on a 3 month contract and was given to understand that if her performance was satisfactory and she fitted into the team then she would be transferred onto the permanent staff at the end of this.

    Things were going well. She was constantly told she was doing well and picking things up much more quickly than expected.

    Unfortunately at the two month point she got sent home at Lunchtime on a Friday after having a small anxiety attack. She was happy to take her lunch and then co e back but her boss said he wanted her to take the afternoon.

    On Monday morning after about 2 hours she was called into the office and told that her services were no longer required because of her mental health problems. Her contract had already been terminated with the agency on Friday afternoon.

    They new she was on medication for depression and anxiety, and also knew that she was under a lot of pressure having just been served notice on her 'rented home, had her housing benefit and tax credits stopped because she was earning too much and been told by the rental agency that her earnings would not pass their checks because she was only temporary.

    This was the only time she had any sickness or absence. She had been told the previous week that she was doing well.

    It seems that she was let go purely because of one anxiety attack.

    I know that can't be right but is there any legal recourse?

        The difficulty here would be proving that the reason for her dismissal was her mental health problems.
        I don't suppose that she has anything in writing from the agency or the client employer saying so?

          I don't believe she does. The agency told her they had nothing in writing and that they would not mention it to anyone else. In one way I guess they think they are doing her a favour by ensuring no record of it. They have simply recorded it as contract ended.

          if there was proof is there anything to be done or as a Temp worker is she effectively completely unprotected?

            They did themselves a favour, not her.
            If her anxiety qualifies as a disability it would be unlawful discrimination to dismiss her because of it. So, by putting a different reason they are seeking to protect themselves from a potential claim.

            If there was proof as a Temp worker she has the same protection from discrimination as an employee.

              Proof being the issue.... plus of course whether there is any point pursuing it.... clearly I would like to see the employer facing up to its responsibilities and showing a more enlightened attitude to mental health, but my partner is in another temp job, with a full time post elsewhere just awaiting paperwork so although a bruising incident for her, she is already on her way to better things.

              Thanks though for helping clarify the position for me.

                Unfortunately business's do what they want, they will always find a way to dress it up as something else, speak from experience.

                Happy she's on the way to better things though, all the best for the future...

                  A lawyer can give you the best answer for this cause. I have a good treatment for your problem ( I speak about depression and anxiety). Kratom is a plant which can help you. After I first tried, I was shocked by the effect and decided to find this plant in the states. It turned out that it was sold completely legally and I began to use it regularly.
