  • Previous Employer Withholding Pay over Uniform

    Hope someone can help with this.

    Long story short, I've had a few family issues, which has meant that I've had to relocate, and accordingly ended up leaving my job. I left on good terms, they didn't want me to leave, I didn't really want to leave them, but family has to come first.

    I worked my notice, but the day after I left I was moving house, so didn't get chance to get all of my uniform back. After moving I started with my new job, didn't get a chance to get the rest delivered to the company.

    Today I was expecting my final pay from them, however come midday nothing was in my account. Speaking to payroll, they've said they're refusing to pay until all uniform is returned, and that I will now have to come and collect a cheque in person. I explained that I now live over 200 miles away, but they said that's not their problem and that they did send a letter (to the address they know I don't live at) explaining this.

    They sent me my final payslip, but didn't pay me a penny. Where do I stand?

    My contract states that any equipment that isn't returned on termination of my contract will be deducted from my final pay packet.

    There is a Royal Mail parcel service to send things back so 200 miles should not be a problem, unless the uniform is particularly heavy or bulky.

      And funnily enough Royal Mail do a letter delivery service which the company could put a cheque through to you... the wonders of modern technology eh?

            First thing is to get that uniform back, signed for parcel. When they have it thenwrite and ask for your full pay as they now have no reason for withholding. If they still want pickup in person then you ask them to pay for your costs in picking it up as they are being unreasonable. Still not joy then a letter before action for the money.
