    Hi, I am after some advice. I started a job in the middle of last year and on my job offer it stated I would be on £9.50 per hour. This is the standard rate of pay for my area in the line of work that I do. I had booked a holiday prior to starring which I told them about and which was fine. This was a few months after starting employment. After the holiday I noticed holiday pay wasn't paid so I asked about it. I was told I was a casual worker (although I worked the same days and times each week) and that casual workers are not entitled to holiday pay. I questioned this and said I was not happy with it. A month later i was told that my holiday pay was included in my hourly rate. This wasn't stated on wages slips etc. A couple of months ago wage slips were changed to state a lower hourly rate amd a separate amount for holiday pay. I continued to say it wasn't right or fair and in the end the director of the company said it isn't working between us and he was giving me 1 weeks notice to end my employment. No holoday pay was paid in my final wage. Where do I stand with claiming back holiday pay for the 11 months I was there?

    You write to them and request it, minus the holiday you took. Here's a link to some information, which also includes a link to a calculator. Make your calculation using the calculator and use the rate given on your job offer. If nothing is forthcoming then it would be a claim via Money Claim Online for the missing money.

    Have you still got that job offer letter? It will stand you in good stead.

    Quite common for employers to state that certain employers are not entitled to holiday pay.

      Yes I have the job offer letter. I took holiday but I wasn't paid for it? So can I claim all holiday pay from the entire time I worked there?

            Yes.
            Also, if your complaints were made in writing and/or they wrote in response you may have a claim for automatically unfair dismissal.
