  • Company squerming in a Employment Tribunal case.

    I am after any help people can give and will appreciate any assistance.

    I am in the process of going through an Employment Tribunal. I had been diagnosed with cancer and four days after that the employer made me redundant. Yeah...great!

    We have been through the 3 month consultancy process as well as the preliminary hearing, but now court date is getting close (Early May).

    The case is pretty solid but the other side are just being utter "you know whats!" and as I do not have a great deal of money and on benefits, while overcoming cancer, I am having to do the case myself.

    I have gone onto Companies House to look at their accounts and now I see they have attempted to strike off the limited company but it was objected to. I have put in a further objection with Companies House as a company cannot be struck while legal proceedings are in play. The company I worked for was sold to another company late last year. So I think they moved all the trading and assets over to the purchasing company and the company I worked for is now just a shell.

    I know they committed two offenses by not informing me of them trying to strike off, S.1006(4) and S.1006(5), but these are rarely followed through by the legal system.

    What can I do? Can I go after the directors? Can I go after the parent company?

    My claim is over £100k, yes above the limit, as there are items that fall outside the limitations. So I do not want to just let it go. I WANT BLOOD just like my hospital does every few weeks.

      The question asked is about companies that "strike off" at companies house during legal proceedings. I need to know if the debt can be passed to the parent company or directors. I am aware that there are issues such as....

      1) Company A was trading in widgets.
      2) Company B buys company A and carries on trading in widgets.
      3) Company B takes on all the assets and trading of A, but assumes none of the liabilities.

      If this is not illegal, I don't know why everyone isn't doing it.

      Alas there are so many elements to this case.

      The core employment law elements of the case are all in hand though.
