  • Suspension on a zero hours contract

    i just got suspended from work due to my behaviour and performance. I was handed a letter and left, there has been no meeting to discuss this. I was given three pieces of evidence for the behaviour and nothing for my performance. Our company policy say suspension is for gross misconduct or a serious allegaation so I'm not sure that this falls into either category, i also don't think they have followed the procedure correctly.
    a question I have is that the procedure says I will receive basic pay during this time - I am on a zero hours contract but have worked 5 days a week average of 30 hours seasonally for the oast 10 years - so should they be paying me this or will they be able to argue zero hours zero pay?
    there are some personal elements to this as I know one of the things I have been told off over involved two people who have been treated very differently. My manager called me into the office and gave me a tellign off in which he was aggressive towards me and made some rude comments, the other person got an informal don't do it again and we know that you're not the problem

    Do you have a contract and if so, what does it say about suspension and whether, despite being on a zero hours contract, you receive any pay and the basis upon which this is calculated e.g. an average of pay per day over a specific period of time?

    My view is that if you have a zero hours contract then unfortunately you are not guaranteed any work and as such your employer is not obliged to pay you for any time you are not working. That is the whole point of such a contract - you are simply not guaranteed any work. So unless there is a provision in your specific zero hours contract to pay you whilst on suspension I would suspect you will not get any pay.

      Thanks, that is what I suspected too - the procedures and handbooks are all set out for permenant staff father than seasonal so it doesn't specify anything for the zero hours seasonal staff.
