  • Cabot reply to CCA request after a year, please help

    Hello everybody, thank you in advance for your help (I posted this yesterday but think in the wrong forum)
    Just under a year ago I received a letter from Cabot demanding payment on an old credit card account (opened 2008 last activity December 2012)
    I replied with the standard CCA request and I have now received a packet containing a few screenshots of the digital application, statement of account and some undated generic T&Cs. I have never seen a deed of assignment or a default notice.
    Owing to ill health I had rather hoped that all this had been left behind me and so receiving this after nearly a year has knocked me sideways
    I have no idea what to do next and I don't want to become ill again with the stress, can anyone please advise me?

    Your health is most important so please don't let this stress you too much - it's only money and they have very little they could actually do.

    So how much approx. is the debt that Cabot are saying is owed?
    Does the debt show on your credit file ?
    Are they threatening court action ?

    You did the right thing sending the CCA request when they chased you last year. Was that letter a formal letter of claim or just a standard debt collection letter?

    Now they have replied you need to assess whether the documents they have sent are correct and compliant and then decide where to go from there. As the account was opened in 2008 it is likely the agreement will be complaint, but whether Cabot have sent the correct one is another matter.

    You could though for now respond thanking them for the documents and ask them to provide the Notice of Assignment and Default notice so you can assess your position with regards their claims. If last years letter was standard debt collection they will have to follow the preaction protocols and send you the letter of claim which gives you 30 days to decide what to do before they bring court action.
