    Hi Josh, I've attached the document with a tidy up of it. You will still need to insert your relevant dates and everything in brackets so make sure you do - attention to detail does count when you go to court!

    I did mention at paragraph 3.5 that you confirmed with the court that the unless order was dispatched on X date. Give the court a call and get that information and put it in as it will help strengthen your case. If they can't give that information then simply remove the sentence.

    You will also need to change the court name to Exeter County Court - don't forget and don't want to have it forwarded onto the wrong court!

    You will also need to serve it on Lowell too, that can be done by email.

    P.s. it is very rough and not exact but simply just a guide as to how you should set it out and explain your defence. Also, I think I've mentioned both Lowell and the Claimant in the documen. You will need to change all references to Lowell to 'The Claimant'

      OK, So ive amended and sent to both the court and Lowell.

      I received an automated email from the court with the following.

      Your email has been safely received by the Civil admin team at Exeter Combined Court. We will endeavour to process or respond to your email within 10 working days. However, please note that if your document requires referral to a Judge you may not get a reply for up to 20 working days. If your email is regarding a complaint, please allow 10 working days for your concerns to be investigated and a response provided.

      For further guidance on complaints please refer to the guidance EX343 on the Justice website www.justice.gov.uk.

      Please note Court staff are not legally trained and cannot provide legal advice. If you are uncertain how to proceed, the Civil Procedure Rules available on the Ministry of Justice website provide details - http://www.justice.gov.uk.

      1. Send your documents once and do not duplicate a copy in the Post/DX/Fax - this reply is your confirmation that your email has been received.

      2. Do not send documents electronically that require a fee, unless: i) Fee Account quoted. ii) Payment by debit card required and contact details given for payment. iii) Application is by Local Authority.

      3. Do not send emails which exceed 10Mb.

      4. When you email the court the subject line of your mail must contain (in the following order): i) If relating to a hearing, the date and time of hearing. ii) The case number. iii) The title of the case (abbreviated if necessary). iv) The subject matter (e.g. defence). v) The judge's name, where the correspondence/document is for their attention.

      Thank you.

      In the 'Subject' I only put 'Claim Number XXXXXX'

      Is that sufficient?

        Each court is different but the basic level of information would be to include in the subject line Claimant v Defendant - Claim Number.

        It should suffice as you've listed the claim number for them to reference but if they are saying you need to be specific and for the avoidance of any doubt, I would follow what they have suggested and re-send an email to that effect just so there is no argument as to whether it was validly filed.

          Not sure if you have already re-sent the email but looking back, there are a few tweaks I would suggest you make.

          You should title the Defence as 'Amended Defence' and underneath that you should put in italics, 'This is an Amended Defence pursuant to an Order made by District Judge [name] dated [date] and is intended to supersede any previous defence in its entirety.'

          And then send to the court and Lowell.

            Only just seen your previous post [MENTION=71570]R0b[/MENTION].

            I had in fact already resent it.

            Could this make a difference to my defence?

            As of yet I've heard nothing more. If i still don't hear anything by the court hearing which is 2pm on the 9th June should I attend? If so I think I'm going to start putting together evidence I.e a copy of Vodaphones T&C's

            What else would you advise I should 'brush' up on?

                Great news, albeit I would still say that the claim is struck out and dismissed but let's not ponder over it, the main fact is that they have sent a discontinuance.

                I would double check with the court towards the end of the week to confirm it has been received and processed. Failing that if the court hasn't received anything by next Monday I would email it to th and confirm the case has been discontinued.

                As a side, I would suggest you retain all correspondence and paperwork for a while, at least until you are certain the 6 year limitation period has passed just in case they decide to sell on the debt or it raises its head again in the future.
