    Thanks Kati.

    I did somehow manage to finagle zoomed images.
    The second (post 52) is re mediation, which Lowells have said 'yes'.
    The third is Lowells stating their preference for Small Claims Track.

              Re: County Court letter from Lowell - Old Vodafone debt

              The directions questionnaire is pretty straight forward, so its a case of filling it out.

              Personally I do not think mediation is suitable for you and is a waste of time which ultimately will delay the trial date, though there will be others who disagree with me. The aim of mediation is to try and come to a settlement based on the evidence from both parties but because you have nothing, you can't aim to settle because you don't have anything which proves you owe this debt. The choice is yours though if you want to agree to mediation.

              Although there is no box which allows you to add additional information, there is the opportunity for you to request that the judge give special directions in addition to the standard directions. The special directions would essentially be an unless order i.e. that unless the Claimant provides you with the documents referred to in its statement of case, the claim shall be struck out.

              the Special Directions are allowed under CPR 27.4 and Appendix C of the Practice Direction 27 sets out some of the special directions that may be given by the judge. I would suggest that a cover letter is attached explaining that the DQ is enclosed and that you also enclose a draft order for Special Directions for the judge to consider.

              You should also send the DQ to the other side, what date do you need to file it?

              You might want to type it out rather than write and you can do it here https://www.moneyclaimsuk.co.uk/PDFForms/N180.pdf
              If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. Please do not hijack another person's thread as I will not respond to you

                Hi Rob, terribly sorry for not replying earlier and leaving this all a mess I have left it till today which is deadline to get this emailed over. I phoned them this morning and the guy told me to email my response back over to them and emailed me a copy of the questionnaire. Do I assume I print it out, fill it in and scan it back to email? I lost my original copy. Sorry it's last minute had so much on at hope with poorly partner and small kids I totally forgot about it until today when my phone reminder told me

                I understand I am to tick "no" on mediation and then fill in all my basic information below that. Do I also select no for section C1? Same for section D 1-4?

                You mentioned some kind of additional information to go along with this. Where do I get the letter template if possible and I will put it in with the email

                Sorry for this rush on I just totally got off track

                  Re: County Court letter from Lowell - Old Vodafone debt

                  Hello, yes print and sign then scan back in then you can email it over to the court.

                  If you want to agree to mediation it is up to you, but if you have no documents provided by them which supports their position and they have refused then I personally see it as a waste of time to accept mediation only to say you don't have the documents and the call is then ended. It also prolongs the court hearing. Others may disagree but its ultimately up to you.

                  C1 you select yes unless the claim value is over £10k

                  D1 you should say that you prefer the claim to be heard at the Defendant's local court and put the address of the court in - https://courttribunalfinder.service....search/address

                  D2 = No

                  D3 = 1

                  D4 = you answer that one yes or no

                  Tick no for interpreter

                    Ok I will get that done now and print and re scan on. What about the other part you mentioned before. A brief letter outlining special directions?

                    Thanks

                      Just drafted something real quick below and you will need to fill in the attached draft order too.

                      Dear Sirs,

                      CLAIMANT NAME v YOUR NAME
                      Claim No:

                      I write with reference to the above matter.

                      Please find attached the completed directions questionnaire.

                      I also attach draft directions containing special case management directions pursuant to CPR 27 (2.2) in which I respectfully ask the Judge to consider.

                        If I fill in that document you attached with obviously my name, theres, case number etc. Do I just save it and attach it along with my questionnaire and use what you typed up there in the email?

                        thank you

                        Also can I just mail lowell my copy of the questionnaire? Or do I email them it too?
