    Okay, Lowell are the creditor (according to their claim against you) therefore they should supply the agreement off the back of your CCA request.

      Indeed, but Capital One still own the debt as far as I am concerned (no assignment letter and they're still sending me statements). I sent the CCA to both of them, but if Cap One do not consider themselves the creditor should they not have forwarded the request to Lowell? In which case Lowell will have had the CCA request twice, once from myself and one from Cap One...

      Mediation has been agreed for the back end of next week.

        Update: This has now been settled at mediation. Just a shame it had to get this far just to accept what I had originally offered nearly two years ago!

            No mediation is to try and come to a arrangement before the hearing.
            then if there is an agreement case is closed

              What was the "final" outcome here a "consent/Tomlin order?"
