Hi Elvis, apologies for missing you over the Christmas Period.

So they have now sent you;

The statement of account and breakdown - any idea what the Adjustment Debt ADTEC is for? May be interest of some sort - did you make that £105 payment ? Just paying off the interest and carrying the loan over for another month ?

The original agreement ( http://legalbeagles.info/forums/show...l=1#post760740 )

Notice of Assignment to MMF

Default Notice ?

At the moment you have a date in the diary for your Mediation appointment.

So the next step would be to decide whether you want to try to settle this claim at Mediation or whether you want to fight on, and do you have sufficient legal ammunition to win the case if you do.

You've left the MMF reference number, original creditor reference and your NatWest personal account number on those uploaded documents in post # 74. You need to remove those details to protect your identity.

Thanks all for the info. Yes to my recollection I paid and rolled the loan over.

If I mediate I am concerned what else they may come after me for, if I fight it I am not sure the best defence or how to go about this.

I don't think I am the best person to comment as I really haven't been that involved with the thread. I thought Amethyst had a handle on what was going on

Elvis -
Did you ever start the affordability complaint as advised several times? I completely understand not wanting to poke anyone that has not started chasing you but for this one , well that boat has sailed and you have been well and truly poked.

You say you are worried that if you mediate they may come after you for others- do MMF own any other PayDay loans

I can't quite make out the total amount of the claim - there seem to be several figures floating around

As Diana M has said, now is the time you need to decide if you want to make an offer or risk a ccj- how damaging would a ccj be to you? Do you rent privately because some private landlords do credit checks etc when you apply to move

It really is up to you - i can not really tell exactly what documents they have sent you or what you have asked for

Sorry

Any further on this? I’m in the same boat at the court DQ stage. MMF also have a few accounts of mine, scared they will chase them, however i did put affordability complsints in against original lender vivus who said they acted responsible. I have had no paperwork from MMF or ML other than bog standard letters. Bit concerned that it might go to court appearance! Eek

Hi yes John I now have a court date set in early April. I have no idea what I am doing or what will happen. I think they are likely to get a CCJ against me as I am not even sure what I am suppose to say in court or do.
