      Yes that's right -any advice today would be appreciated- do I defend this - I have to do it today if so or I am assuming I will get a CCJ and am back to square one with my credit file if so which I will be absolutely gutted by.

        Where do you put in your mother's maiden name and IP address ? ( I mean when doing the application was there boxes to type these things in, are they printed on the copy agreement ?) Just seeing what it says under the signature box. ( Is that your handwritten signature btw or a computer font ?)

        So this claim is for just under £700 ? the NOA says £798 ?- - any idea where MMF have got the additional £1400 from ? Have you got any other PDL's lurking in the background they might have taken on ?
        No idea how they got the amount up to over £2.1k - think that needs explaining as well as how it got to the alleged £798 at the time of assignment. Are there any default/collection charges showing on that agreement ?
        The Notice of Assignment - seems to be only from MMF - anything from Mr Lender ?
        Any default notice ?

        5781% APR is bonkers. Thank goodness for caps on high cost credit.

        Well, you could put a defence in, basic standard defence ( CCA / CPR etc ) and then assess the documents you receive/d and then negotiate settlement by installment with the claimant - hopefully under a consent order to keep the court claim on a stay in court in case of default on the arrangement.... or you could try negotiate a settlement now without entering a defence - entering an admission/offer through the court will give you a CCJ, and doing nothing will give you a CCJ. You should have the weekend to sort your defence out to file Monday if you've got your dates right ( what was the actual date of issue? )

          I appreciate the reply an helping me with this - i have learnt I have till Monday as you have mentioned.
          I have covered my signature- I did not put mums maiden name but may have electronically elsewhere.
          i am not sure were the additional costs have come from to initialy get it from 300/400 to 700 plus, I am then not sure we're the 2000 comes from but yes their may be another possible one lurking as I say.
          Nothing from Mr lender as this come from MMF
          should I continue to file my defence the same as I posted earlier?? Or change it ?? Sorry really unsure what I should do.

            I know this is not going to seem urgent, but how are you getting on with affordability complaints? Court cases take quite a while to go through and then if you lose you have a month after getting the CCJ in which you can pay it off and have it removed from your credit record... so if you can pick up enough refunds from payday lenders, you may be able to emerge with a clear credit record even if you lose the case.

                Does the what that I do not owe MMF anything count for a defence as the loan was with mr lender - so technically I do not owe MMF anything ?? What should my defence consist of - should I file the one I posted earlier on in the post??

                  That is not a defence. Mr lender were entitled to sell your debt to MMF, you now have the same obligations to MMF that you previously had to Mr Lender.

                      I looked into the affordiabilty complaints however I am really conscious to not open any skeletons lurking as I did have mulitiple paydays in the past which were rolled over and not fully paid back in some case.

                        In which case do affordiabilty complaints to each & every lender you borrowed from regardless of whether you paid them back or not. Do each & every one of them. So you managed to pay some back but you only managed to do that at the expense of getting in debt with others. The lenders were either legit or not & the fact you happened to pay one or two back does not make them less liable.

                              I am not sure there is any real proof of that debt purchasers make decisions based on all sorts of things which may include what they can glean from your credit report Also if for example you have already complained about the handling of the loan and it has been passed back for example then who knowsFrom what I can see many of the PDLs being litigated at the moment are those from more recently after the ‘industry’ supposedly cleaned up their act

                                I received a letter today from Moriarty Law stating that their client ( MMF) acknowledges my defence and is still proceeding with the claim.
                                any idea what I should do next, I assume I will receive something from the court next?
