    Hi there,

    I am experiencing the same situation with Drydens on behalf of Arrow Global for an EGG loan that I defaulted on in 2010.

    My N1 is exactly the same but says Egg instead of MBNA.

    I read the advice from [MENTION=55034]nemesis45[/MENTION]:

    "The first thing to do is acknowledge service of the claim,
    do this a Money Claim on Line (MCOL) and state intention
    to defend.

    Then a request to AG for a copy of the agreement relevant to
    the alleged debt.(CCA Request)
    There is a £1 statutory fee to pay use a Postal Order endorsed
    " For Statutory Fee Only" ( Template in the forum library)
    AG has 12 + 2 Working Days to comply.
    Is there a solicitor involved with this?"

    "You also need to send a Request under Civil Procedure Rule 31 .14 (CPR31.14)
    to Drydens ( No fee) the is for production of all/any of the documents mentioned
    in the particulars of the claim in this claim: The Credit Agreement. The Default Notice. and The Notice of Assignment.
    Nothing else can be requested. ( personally though I would request the " sales agreement between Arrow and AG " as well."

    I am in the process of responding to the Claim Form I received via moneyclaim. In the 'Dispute Reasons' section, I selected:

    Do you dispute the claim because you have already paid it?
    *
    No, for other reasons
    (and not "Yes, I paid the claimant")


    It then led me to this in the 'Defence Particulars' section:

    Please complete all fields marked
    *
    Please state your defence in a maximum of 122 lines in the box below.*


    Have I selected the correct answer and if so, what do I write as my defence?

    I will also send a CCA to Arrow Global and Request Under Civil Procedure to Drydens, as advised, I just want to get this moneyclaim bit done ASAP.

    I'm also intrigued to know if anyone has been successful in these steps and avoided a CCJ?

              When you acknowledged the claim did you tick defend all?

              you have 33 days from the date of the claim to file your defence IF you have acknowledged it.

              you need to be waiting to nearer the deadline to see if they come up with ant documents.

              In a CPR 31.14 request you can only request documents mentioned and adding anything else will slow things down as they will use it as an excuse not to comply.

              How much are they claiming and when was the loan taken out?

                Thank you for taking a look at my post.

                On the MCOL website I inputted the Claim reference and selected this option:

                Start Defence
                If you dispute the whole claim or wish to make a claim (a counterclaim) against the claimant, complete the defence form.


                It then took me to this option:

                Do you dispute the claim because you have already paid it?
                I selected * No, for other reasons

                The next window asks me to:

                Please complete all fields marked *
                Please state your defence in a maximum of 122 lines in the box below.*

                I haven't written anything yet.

                The MCOL homepage on my account now has this (i've taken out my name and claim number):

                07/03/2016 Arrow Global Limited Defence









                Does this now mean my claim has been acknowledged and I am not going to get a CCJ?

                They are claiming my debt of £4,262 + Court Fee of £185 + Legal representative costs £85 = TOTAL £4527.69

                I took the loan out in 2002

                So should I now send a CPR request to Drydens and then file my defence just before the 10th of April (the 33rd day?) or is there something more I need to do on MOC?

                    I misread the moneyclaim website and I filed a defence 14 days after the issue date and not the Acknowledgement of Service.

                    I have submitted the Acknowledgment of Service today just in case but it's 28 days after the date of issue so i'm not sure if it counts.

                    Have I messed it up now? Do you think I will receive a CCJ?
