        The claimant has 28 days from the date it received the defence if they do not respond the court will stay the claim.

        You will Not be informed if this happens so regular checks with the court after the 28 days expire will be needed, if the claimant responds ( usually a letter say they intend to continue) the court process then carries on and you will receive documents from the court to complete and return.

          Thank you [MENTION=55034]nemesis45[/MENTION], i think what op is wanting to know is how you go about getting the case completely struck out, because i think if its stayed, the claimant could still apply to the judge or something like that.

            The situation could back fire at this early stage (personal experience) they would/could make extensive searches etc and produce something which some DJs will accept albeit might be not correct, i.e. the DJ I had was anti debtor and no matter the evidence they circumnavigate around the truth on stupid technicalities = has happened Twice to me. so is the dirty state of debt collection and court appearance = translated into = Ministry of Injustice is a money making Quango!! its 1st priority!

              A judge would not order a strike out at this stage while the claimant still has time to respond ( within 28 days of receiving the defence) waste of the application fee.

              A claimant can at anytime when a claim is stayed apply and pay a fee for the stay to be lifted.
