      Thanks Amethyst. you guys have been genuinely awesome. See above I think I'm out of luck as I stupidly paid them some money in Aug 2011 as per their letter while clearing other debts.

      I've weighed it all up (stress, time etc etc) and I now think my main objective is to avoid the CCJ.

      How would I go about this, I cant change my plea on the Mcol website.

        Should I just phone Caters and get them to set up a Tomlin Order?

            Thanks for the bump! It really pains me to give in to these Carter p**** but I've been digging and I was making payments for it to JB Debt Recovery all through 2010 up till 2011 so it's not statute barred.

            I don't see I have a leg to stand on even though it's very unlikely they will be able to produce a CCA.

            I just want to avoid a CCJ on my record. I've got a PPI claim in the works which, if successful, will cover the cost.

              So after a bit of digging seeing as the debt isnt strictly statute barred (I gave into the relentless letters and calls) I find that this debt is pre 2007 so unenforcable without a signed CCA. I'm sending a paid request for that asap.

              Does anyone know if it still unenforceable if they cant produce even though I paid money towards it?
