  • Restons Solicitors

    Hi,
I’m new, after getting myself into a massive pickle over 10 years ago, I have slowly managed to pay off 95% of my debts ( which were quite large ) all without any CCJs. I have one remaining with a catalogue which was for £900. I paid £135 to a company last year but after repeatedly not providing me with a receipt or contact I stopped, in March I received a really threatening letter from Restons which I responded to offering £50 a month, in the meantime whilst waiting for a response I started to pay whatever I could online and have made a payment of £75 and then on between £5 and £25 every week without fail with no gaps , to date I have repaid over £200. Today I received a court claim out of the blue and getting hold of them is beyond impossible . I don’t know what to put on the form , I’ve worked tirelessly to free myself over the years - can anyone please advise ? Thank you in advance .

        Hi Gertie

I know the feeling of abject panic that happens when you get a claim- been there myself

I think it is time to play the game and make Restons do some work.

Can you type out the particulars of claim as they appear on the claim form, but do not put any names, exact amounts or account numbers on.

the first job is to acknowledge the claim online - shout if you need help on that
        Acknowledge Claim

The next job is to send a CCA request to whomever is the claimant- send it royal mail signed for with the £1 fee and send a copy to Restons but mark that one for information purposes only

        CCA Request

You will also need to send a CPR31.14 request to Restons but you can only ask for documents that appear in the particulars of claim

There will be lots of opportunities to sort this out before it gets to court but you need to 'play the game'
