  • Money Claim Online defence help

    Hi All. I'm about to embark on writing my defence for a money claim online that has been sent to me. I'll bullet point out the story here in case anyone fancies helping. If there is any help available that would be ace as I'm not sure the best approach to writing it and when you're in the mood I'm in it's pretty hard to keep it professional.
    • I worked at a very small company for 10 years and became co-director and 10% share holder
    • The plan was for me to buy the company and for the 90% owner to retire
    • Although this was in the making for around 3 years in September of 2017 he changed his mind so I had to hand in my notice as without the potential for a future at the firm there was no desire to stick around
    • Having worked 4 weeks notice, my last day was 29/09/17 at which point I received my salary, outstanding expenses and £5000 for my shares
    • Back in August I received a bonus of £7250 in cash (tax elements are sorted by MD and accountant)
    • On 30/11/17 I get a letter saying that I owe him £7250! I respond and say I don't, try to call him but he hangs up on me. The letter has 2 "invoices" attached which are clearly fabricated in Word and bear no resemblance to the invoices that come from the accounting package and the accompanying letter says and I quote "Can you arrange ASAP payment of balance current held by you (£7250.00)?"
    • I don't owe this money as it was given to me as a bonus. on 08/12/17 he sent another letter saying basically the same things again. I tried to call and email but still got nowhere
    • On 23/12/17 (nice timing for Christmas) I receive a money claim online from him which I now need to provide a defence for


    Not much of it makes sense and it's hard to know what he's even claiming due to the incoherent nature of his communications. He doesn't claim it was a loan he just says he gave it to me and now he wants it back?!?

    Anything that you can all do to help would be amazing I need to get it written and sent by the end of the week (I've got another week but I'm going to be out of the country).

    Have you acknowledged the claim yet? If not then do it NOW. The details and instructions are on the form, together with the password. Do not enter anything in the defence area of the response. This gives you 33 days from the date of issue of the form to get your defence in to the court..

    What exactly is in the Particulars of claim?

      Thanks for the replay! I have acknowledged the claim and said that I want the time to create my defence. Unfortunately due to Christmas and a ridiculously heavy workload at the moment I've now only got until the end of next week to get it submitted. I've attached scans of the files to this so you can see the particulars... It's wishy woshy to say the least!

      Any help is appreciated, I don't fell like I'll do it justice. It seems a bit his word against mine but then what's to stop anyone just randomly claiming money off people if that's the case?
