    Hello

    i have received a letter before claim and a 50 % settlement letter - deadline for letter before claim is 2 Jan / settlement letter is 19 Jan. If I accept the settlement letter by 1 Jan in writing does that mean I don't post back the letter before claim?

    What is the date of the letter before claim and how long does it give you to respond? If the settlement letter suggest the offer is open until 19 January then you have until the 19 January to accept the offer. If they issued proceedings and you subsequently accepted the offer then they would need to withdraw their claim as the matter has been settled. Whether or not you pay their legal costs or any other additional costs will depend on the wording of the settlement letter. For example, if the settlement says 50% of X in full and final settlement then you wouldn't be liable for any additional costs other than 50% of X.

    A little further background to this would be more helpful. What does the claim relate to?

      If so it may make sense to merge the threads so the history can be seen by those helping you.

      Without knowing the full background I would advise that you send back your response to the Letter Before Claim to arrive before the deadline regardless of any offer on the table. Once the deadline has passed the creditor/debt owner can issue a county court summons at the click of a mouse.

      Be careful when negotiating to head all correspondence 'Without Prejudice' to avoid any perceived admission of the debt which could be disclosed to the court as evidence by the other side.
