I also said that if I was a forum owner and received a letter like that I would report her firm to the SRA. I also reminded her that RLP has no basis in terms of law whatsoever, and that the retailers should deal with the relevant authorities instead.

Alexandra got surprisingly quiet. She didn't know what to say but I think she was upset about my rant!
I believe the term for it is "getting owned".

Sorry, and correct me if I'm wrong , but ... didn't the UK LOSE trespass laws not so long ago?? I was sure that you couldn't be arrested for 'trespass' any more ....

Surely, if there is no such thing as trespass in the UK now, no-one can threaten you with a lawsuit on those grounds??! :noidea:
Debt is like any other trap, easy enough to get into, but hard enough to get out of.

It doesn't matter where your journey begins, so long as you begin it...

That's a very interesting question (observation), Kati. I got into hot water on another thread on this very subject (but involving Bailiffs  ), not so long ago. Trespass laws having become impossible to enforce - and now, of course, there is the "right to roam" - so there has to be some kind of criminal damage, I believe, to have any kind of legal (even civil) redress.:tinysmile_hmm_t2:

Probably not relevant to this thread (my world being more agricultural, lol - but it's the same principle) x

Re: What should you do if you are contacted by a civil recovery firm ?

Have RLP and TK Maxx produced any evidence to prove their allegations? No.

Have RLP any authority to act on behalf of T K Maxx other than to extract money from people a court of law has told them and one of their clients they have no grounds in law to do so? I doubt it very much.

I note RLP has sent you one letter. Let them send you another or, maybe, two and then we can help you put them and T K Maxx back in their boxes.

Did the store recover the goods in undamaged and saleable condition? If so, they have suffered no loss. When you say you were caught shoplifting, are you sure this was intentional and not some unreliable technology or over-zealous security goon on an ego trip?

Was your son under 18 or over 18? Cruse, a charity, may be able to help you, but there may be other groups who can help you as well.
