  • Refund onan item paid for in full via bank transfer but delivered faulty

    Hi again.

We bought a quad from a dealer on a classified ad on ebay. We paid the full price immediately and came with 12 months warranty. We waited just over 2 weeks for it to be delivered which was annoying as we needed it for our small holding.

After starting it up ready to use that afternoon it had no power steering. Got back to the dealer immediately who then arranged for a part to be sent to us to try and fix it and also offered another 12 months warranty for the inconvenience.

Part took another week to arrive... we fitted the second hand part when it arrived and it cured the power steering but then the 4 WD wouldn't work.
The dealer said he will order a new part but another 2 weeks has gone by and still no sign.

We have now had to buy another machine as we are desperate to get the work done . No communication from dealer at all.

Done some digging and he has set up numerous companies and just dissolved them, he doesn't appear to own anything..he rents his home and car is on finance. The company name he used on the invoice is now in the process of being struck off (this has happened in the last few days )

We have requested our money too be refunded but he never gets back in touch.

Can I try through a small claims court as it was 3595.00 or am I fighting a losing battle ?

He is still selling quads but his premises is a small unit which has no landline or internet and he appears to just store the machines in the lock up and sells from his home address as that was where the pallet company picked this quad up from

    TIA

Hi Walesman, yes when we started to worry a few weeks ago and done a lot of digging we found the reviews weren't quite what they seemed... going through Companies house he has set up numerous companies in his or his wife name and the previous companies reviews were awful and many going through the same thing as we are
